My theory is this: The reason why the Presumption of Innocence of a person accused of committing a crime is recognized as a fundamental freedom and guaranteed by many States in the world through their constitutions, laws, rules and regulations is that human beings, including myself, have this TENDENCY TO BE IRRATIONAL enough to be biased in throwing their judgments against a person. This is exemplified by the posts and comments of many Diehard Duterte Supporters (DDS) we have recently observed both online and offline.
Another instance was during our One Billion Rising Cebu 2018 event, last March 8, for the International Women’s Day at Fuente Osmeña Circle, Cebu City. An old man, clad in a long-sleeved polo barong who turned out to be a DDS, entered the Circle and attempted to interrupt the person who was delivering a solidarity message on stage. A colleague, with a smile on his face, calmly told the old man to just respect the opinion of the speaker. Apparently, the old man got annoyed by the speaker’s message which contained criticisms against President Duterte’s and pro-imperialist/pro-oligarchs/anti-poor policies. Our colleague kept on telling him to respect the speaker’s views.
The old man, on the other hand, kept on calling the speaker’s attention, asking aloud, “Kinsa imong kontra? (Who is your enemy?)”. He also kept on telling us statements like: “Pataka lang man na siya (He does not know what he’s talking)”, “I came from Malacanang” as if to scare us. UNTIL he repeatedly uttered, “Unsa man, ipa-TOKHANG ta na siya (What now, shall we have him killed)?” That struck us and prompted our colleague to call for the assistance of our own marshals. Our marshals succeeded in calming him down and the event ended successfully and peacefully.
Imagine that any person could just easily condemn another using the force of the law or the bullet of a gun WITHOUT DUE PROCESS. THIS IS DANGEROUS as it could take one’s life away, actually or constructively, without the benefit of an in-depth investigation and the opportunity for him/her to defend himself/herself. It is for this reason, as well, why many justice systems in the world, except those that adopt the jury system, leave the judgments of conviction or acquittal to persons (judges) who are supposedly learned of the law and with demonstrable capacity to sift through the evidence presented for and against the accused without any taint of partiality as the blindfolded Lady Justice depicts.
Section 1, Article III (Bill of Rights) of the 1987 Philippine Constitution expressly provides that [n]o person shall be deprived of life, liberty, or property without DUE PROCESS of law. Section 14, Article III of the Constitution likewise provides:
Section 14. (1) No person shall be held to answer for a criminal offense without DUE PROCESS of law.
(2) In all criminal prosecutions, the accused shall be PRESUMED INNOCENT until the contrary is proved, and shall enjoy the RIGHT TO BE HEARD by himself and counsel, TO BE INFORMED of the nature and cause of the accusation against him, TO HAVE SPEEDY, IMPARTIAL, and PUBLIC TRIAL, to meet the witnesses face to face, and to have compulsory process to secure the attendance of witnesses and the production of evidence in his behalf.
In the same manner, the Universal Declaration of Human Rightsguarantees the right to be presumed innocent and the right to due process as follows:
Article 11.
(1) Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defence.
May we IMPREGNATE these FUNDAMENTAL rights in our minds and may we UPHOLD the RULE OF LAW rather than the rule of the mob, DEMOCRACY rather than mobocracy.

On another note, albeit late, I would like to express my warmest congratulations to our sisters and brothers in GABRIELA CEBU as well as the other convenors and organizers for successfully holding ONE BILLION RISING CEBU 2018 with a timely theme “RISE! RESIST! UNITE!” and in time for the International Women’s Day.
I was a graduating U.P. student when I volunteered to assist GABRIELA CEBU, UP Cebu GAD, and others in organizing the FIRST ever ONE BILLION RISING CEBU which was graced by around 2,000 women, men, youth and children at the Ayala Cebu Terraces last February 14, 2013.
As women hold up half the sky, said Mao Zedong, women hold up half of the struggle towards national liberation and democracy since the Spanish conquest until at present.
Abante, Babae! Palaban, militante!
Cebu takes part of the annual worldwide event One Billion Rising with this year’s theme, “Rise! Resist! Unite!” One Billion Rising was first launched on February 14, 2013, spearheaded by feminist-activist Eve Ensler.
Groups demanded for the immediate release of University of the Philippines (UP) Cebu alumna Myles Albasin and her companions. Albasin and five others were reportedly “captured” during an “encounter” by elements of the 62nd Infantry Batallion of the Armed Forces of the Philippines (AFP) last March 3, 2018.
No Encounter
The military accused and tagged Albasin and her five companions as members of the New Peoples Army (NPA). They were “arrested” at the house of a certain JC Cadiente in Sitio Talingting, Brgy. Luyang, Mabinay.
However, contrary to military claims, residents of Sitio Talingting revealed that there was no encounter between the AFP and NPA. According to reports received by Aninaw Productions, a resident who requested anonymity said that they heard only three gunshots and that there were no wounded or dead bodies.
The resident also shared that military operations hound their area. According to the resident’s testimony, Cadiente was harassed and “drowned” by military elements for “allegedly housing rebels.”
Albasin and five others are detained in a military camp in Tanjay, Negros Oriental.
“We challenge the authorities and the media to conduct further investigation on what really happened on the ground and to address the harassment done to the residents of the area,” exclaimed Anakbayan Cebu’s Joisa Cesista.
A Selfless Scholar of the People
Myles Albasin graduated in 2017 with a BA Mass Communication degree from UP Cebu.
She served as secretary general of Nagkahiusang Kusog sa Estudyante (NKE), a political student alliance in UP Cebu, that actively campaigned against anti-student and anti-people policies such as tuition and other school fees increases, pork barrel and corruption, oil price hike, militarization of Lumad communities, and extra-judicial killings, among others. Albasin also became Anakbayan UP Cebu’s chairperson for two years.
According to a statement released by Anakbayan UP Cebu, Albasin did not let her studies interfere with her learning. “She did not limit her education inside the four walls of the classroom. She actively joined discussions and study groups which educated her on the political situation and problems faced by the country. Her heart has always been for the exploited and oppressed masses,” the statement read.
Albasin initially planned to pursue a degree in Law after she graduated. But according to Anakbayan UP Cebu, Albasin was “fearless” in her “decision to integrate with the basic masses. Together with other youth and student leaders, she regularly integrated herself with the masses – farmers, fisherfolks, workers, urban poor, jeepney drivers, Lumads of Mindanao, and other exploited and oppressed sectors of society.”
Dugang Kadasig
Students, teachers, lawyers and human rights advocates, and friends of Myles Albasin, have been unwavering in their testimonies in support of the campaign to free her and her companions.
Former UP Cebu Student Council Vice Chairperson Kristian Jacob Lora touted Myles as “an epitome of the Filipino youth whom Jose Rizal referred to in his poem and in his novel, El Filibusterismo.” Lora added, as if speaking directly to Albasin: “You got out of your comfort zone to live with the masses, the marginalized, the oppressed… a thing which WE, in the MIDDLE-CLASS, FIND IT HARD TO DO. So, we salute you, we look up to you, and we are very much PROUD OF YOU for your SELFLESSNESS!”
UP Diliman Prof. Sarah Raymundo painted a lighter version of Albasin, while at the same time lauding her militancy and progressive politics: “you were the unassuming, gentle type yet a slave to uncontrollable laughter when rude but truthful jokes buzz around… The speeches you delivered in at least two occasions at Sitio Malungon were powerful. So powerful, you cease to be yourself as you transform into a beast.”
UP Cebu Prof. Phoebe Zoe Maria Sanchez stressed that “there was no encounter when they were captured, and they (military and police) should not touch anyone of them or harm them!” Sanchez also called the AFP as “the official station for public lies and deception” as it continues to spread “fake news” about Albasin and her companions.

Isip graduates, makaingon kita nga luwas na kita aningmga problemaha. Apan dili. Mga Iskolar ng Bayan, ig-gawas nato ngadto sa atong katilingban, aduna lang kita’y duha nga mga kapilian: ang mutrabaho ug muserbisyo sa mga namig-ot o sa mga gipig-ot? sa mga nang-abuso o sa mga gipang-abuso? sa mga nanghimulos o sa mga gipanghimuslan? sa Daang Matuwid o sa Tamang Daan? sa pagpabilin sa kasamtangang kahimtang o sa pagduso og kabag-uhan?
Nan, nasayod ang tanan nga kita ganahan og kabag-uhan saatong katilingban. Apan, labaw pa sa atong partisipasyon sa umaabot na eleksyon pinaagi sa pagpili sa mga makabayan ug makamasang lider, mahitabo lamang angtiunay nga kabag-uhan kon kitamusalmot sa nasudnong-demokrasyang kalihukanalang sa pagbag-o sa katilingban. Atong ihiusa ang atong mga kusog sa kusog sa masang katawhan.
Isip mga Iskolar ng Bayan nga gipa-eskwela sa katawhan, responsibilidad nato nga ubanan ang katawhan sa pagpangita’g tiunay nga hustisya ug kauswagan. Responsibilidad nato nga ubanan sila:
sa pagduso sapag-apud-apod sa yuta ngadto sa atong mga mag-uuma sama sa mga mag-uuma sa Hacienda Luisita ug Aloguinsan;
sa pagduso sa dugang nga suweldo ug benepisyo sa atong mgaginikanan ug sa tanang mga mamumuo;
sa pagduso sa dugang ug sakto nga badyetalang sa edukasyon, healthcare, housing ug uban pang mga batakang serbisyo;
sa pagprotektar sa atong mga kababayen-an ug kabataan;
sa pagprotektar sa soberanya sa atong nasod gikan sa mga langyaw ug imperyalista; ug,
sa pagprotektar sa atong kalikupan alang usab sa mga musunod nga kaliwatan.
Kay kita, dile lamang Iskolar para sa Bayan. Kita, gitawag nga mga Iskolar NG Bayan kayKAUBAN dapat kita sa katawhan sa pakigbisog alang sa katungod ug kaayuhan sa tanan ug alang sa tinuod nga kagawasan ug demokrasya sa atong nasod Pilipinas. Ug ang masang katawhan ang mao’y katapusang hukom kon kita, matinud-anon ba sa atong paka-Iskolar ng Bayan.
Busa, ang dakong hagit sa ato-a, bisag asa man kita maadto o muadto: be a true Iskolar ng Bayan!

Subalit, kahit nakasungkit tayo ng mga kapanalunan, patuloy pa rin ang bulok na sistema sa pagsupil sa atin na mga estudyante at kabataan. Kahit pa man na ipinalalandakan ng administrasyong Aquino ang dagdag na badyet sa UP at SUCs, mayroon pa ring 17B pesos na pagkaltas sa badyet na ipinanukala ng mga SUCs sa taong ito. Patuloy pa rin ang pagtaas nga mga matrikula at iba pang mga bayarin sa mga publiko’t pribadong paaralan sa ilalim ng komersyalisadong sistema ng ating edukasyon. Sa katunayan, atin pong nasaksihan nitong Marso kung paano pinatay ng bulok na sistema, gamit ang mga mekanismo nito gaya ng Tuition Increases, STFAP, Student Loan at iba pa, ang ating kapwa Iskolar ng Bayan na si Kristel Tejada at kung paano rin pinatay nito ang mga pangarap ng mga kabataang ninakawan ng kanilang karapatan sa edukasyon.
Bilang mga gradweyt, inaakala nating tayo’y ligtas nga sa mga sularining ito. Subalit, hindi. Sa paglabas natin mula sa Unibersidad na ito, lalo na sa ating pagtatrabaho, tayo na naman ang makakaranas ng lahat ng mga paghihirap ng ating mga magulang at ng sambayanan — tayo na naman ang masasaktan sa pagtaas ng presyo ng mga bilihin, sa kahirapan sa paghahanap ng trabaho at pang-aabuso ng mga employers, sa mahal na pamasahe dahil di na tayo pwedeng magsabi ng “estudyante po Kuya, estudyante po“, at sa kahirapan sa paghahanap ng perang pantutustos para sa pag-aaral ng mga magiging anak natin. Dito na natin makikita at mas mapapatunayan na ang mga problema ng mga estudyante ay tunay na di hiwalay sa mga problema ng lipunan. Nasa loob o labas man ng paaralan, tayong lahat ay apektado sa mga kontra-mamamayan na mga polisiya sa Daang Matuwid ni Aquino na klarung-klaro na para lamang sa imperyalistang US at ang mga tuta nitong nanggagaling sa naghaharing-uri ng ating lipunan.
Mga Iskolar ng Bayan, sa paglabas natin patungo sa lipunang ating ginagawalan, tayo ay may dalawang pagpipilian lamang: ang magtrabaho’t maglingkod para sa mga nanunupil o sa mga sinusupil? sa mga nang-aabuso o sa mga inaabuso? sa mga nagsasamantala o sa mga pinag-sasamantalahan? sa Daang Matuwid o sa Tamang Daan? sa pagpapanatili ng status quo o sa pagsulong nga pagbabago sa lipunan?
At alam naman ng lahat na gusto natin ng pagbabago sa lipunan. Datapuwa’t, mas higit pa sa ating partisipasyon sa darating na eleksyon sa pamamagitan ng pagboto sa mga makabayan at makamasang lider, magaganap lamang ang tunay na pagbabago kung tayo ay lalahok sa pambansang demokratikong kilusan para sa pagbabago sa lipunan. Ating ipagsama ang ating mga lakas sa lakas ng masang Pilipino.
Bilang mga Iskolar ng Bayan na pinag-aral ng taumbayan, responsibilidad natin na samahan ang taumbayan sa pagkamit ng tunay na hustisya at kaunlaran. Responsibilidad natin na samahan sila:
sa pagsulong ng pamamahagi ng mga lupain sa ating mga magsasaka gaya ng mga magsasaka sa Hacienda Luisita at sa Aloguinsan;
ang pagsulong ng dagdag na sahod at benepisyo sa ating mga magulang, guro at sa lahat ng mga manggagawa;
ang pagsulong ng dagdag at saktong badyet para sa edukasyon, healthcare, pabahay at iba pang mga batayang serbisyong-panlipunan;
ang pagtatanggol sa ating mga kababaihan at kabataan;
ang pagatanggol sa ating soberanya mula sa mga dayuhan at mga imperyalista; at,
ang pagtatanggol sa ating kalikasan mula sa mga pang-aabuso para sa mga susunod na henerasyon.
Sapagka’t tayo ay hindi lamang mga Iskolar para sa Bayan. Kundi, tayo ay tinaguriang mgaIskolar NG Bayan dahil tayo ay KASAMA ng taumbayan sa bawat laban para sa karapatan at kapakanan ng lahat at para sa tunay na kalayaan at demokrasya sa ating bansang Pilipinas. At ang masang Pilipino ang silang huling maghuhusga kung tayo ba ay tunay ngang mga Iskolar ng Bayan.
Bagkus, isang malaking hamon sa ating lahat, kahit saan man tayo mapunta o pumunta: be a true Iskolar ng Bayan!

UP NKE condemns warrantless arrest of Badidi Labra’s father; calls to drop charges

The Nagkahiusang Kusog sa Estudyante, a political and mass organization in University of the Philippines Cebu (UP Cebu) expresses its strongest condemnation over the inhumane and warrantless arrest of Lodgerio Labra, father of UP Cebu Fine Arts student Jay “Badidi” Labra, past 8 p.m, February 18, by the Team 2 of the City Intelligence Branch (CIB) of the Cebu City Police Office (CCPO) under Police Inspector William Alicaba.
Based on the accounts of Badidi Labra, who is one of the witnesses of the said arrest, PNP crashed into their house to arrest Mr. Labra for illegal gambling, specifically, masiao. The PNP ransacked the house which resulted to damages on Labra’s properties as they sought for any evidence supporting the case. Failing to find evidence, the CIB took Mr. Labra’s decades-old unused and non-functional .22 rifle (air gun).
Furthermore, Badidi testified that the arresting officers failed to present an arrest warrant, were not in uniform and even threatened to arrest him, as well, after seeking for an arrest warrant.
This afternoon, February 20, Mr. Lodgerio Labra has been freed on bail. He was detained in CCPO, yesterday, after the PNP filed two cases against him yesterday, February 19, for illegal gambling and illegal possession of firearms. Gambling paraphernalia surfaced only after the raid and when asked where they found the paraphernalia, the CIB could not answer the question, said Badidi. He added that the CIB negotiated to drop the charges in exchange of suppressing the issue from media attention.
Not an Isolated Case
Such inhumane acts of the security forces of the State such as the Philippine National Police (PNP) and the Armed Forces of the Philippines (AFP) inflicted upon ordinary and innocent civilians are no longer unusual in our history. There are already a significant number of cases of police officers illegally arresting civilians without warrant, torturing them upon arrest and destroying properties while searching for evidences, among others. In the case of Mr. Labra, the arresting officers violated the rules in conducting an arrest stipulated in Republic Act No. 7438 such as using of unnecessary force despite his non-resistance and non-recital of the Miranda Warning.
Even the planting of evidences (the gambling paraphernalia allegedly recovered from Mr. Labra’s house) is also not new. It can be remembered that three of our UP Cebu students who visited the Aloguinsan farmers to document their struggle were also arrested last August 29, 2011, along with 36 farmers of San Roque Farmers’ Association after the PNP allegedly found acid, grenade and liquid laced with chili pepper inside their bags.
The case of Mr. Labra is yet another incident now added to the very long list of human rights violations committed by the State’s security forces. This incident further our claims that the institutions that are ought to serve and protect the people are the ones inflicting abuse, harassment and violence upon the people, especially the underprivileged and the powerless.
Our Call and Demand
Considering that the arrest of Mr. Lodgerio Labra is illegal and that evidences presented were only planted, we demand upon the Cebu City Police Office to immediately drop the charges filed against him. Furthermore, we call for an investigation of the incident and have the arresting officers held accountable for violating Republic Act No. 7438.
We are also calling the attention of the Commission on Human Rights-7 to look into this matter and conduct a speedy investigation to render justice to the party affected.
